Terms and Conditions for Software and Web Development Services by ECA Tech Inc.

These Terms and Conditions ("Terms") govern the services provided by ECA Tech Inc. ("ECA Tech", "we", "us", or "our") for software web development projects ("Services") to the client ("Client", "you", or "your"). By engaging ECA Tech for Services, you agree to be bound by these Terms.

Our services include professional website design and web application or software development, implementation of content management systems (CMS), development of advanced website functionalities, seamless integration with third-party applications (APIs), creating responsive designs for various devices and utilizing basic on-page search engine optimization (SEO) techniques.
Please ensure that your project requirements are clearly communicated in detail, with all necessary content such as text, images, and videos provided in a timely and professional manner. We kindly request that you approve all designs and functionalities at designated milestones, and obtain all necessary licenses or permissions for third-party content. Additionally, please ensure that we are granted access to your domain name and hosting account (if applicable) for a smooth and seamless collaboration. We kindly request that you respond to all inquiries and requests for information promptly and professionally. Thank you for your cooperation and commitment to a professional partnership.
Project timelines and fees will be thoroughly defined in the Proposal. Adjustments to the timeline may be required due to changes requested by the Client or content provided by them. Additional fees will be applicable for significant changes outside the scope of the Proposal. Payment terms will be outlined in the Proposal, where a deposit is required to initiate work. Progress payments are due at designated milestones, with a final payment upon completion and project acceptance. All custom codes developed by ECA Tech shall remain our intellectual property, and the Client will retain the rights to the content provided by them. ECA Tech is granted a non-exclusive, royalty-free license to use portions of the final website for marketing purposes.
Expanding project requirements or scope creep can have a significant impact on the cost of app development. Here is a breakdown of the effects: When additional features or functionalities are requested after the initial development phase, this requires more time for developers to complete the project. As developers usually bill by the hour or by the project, this can result in increased costs. At times, scope creep may require bringing in additional developers to complete the project on time. This can lead to higher development costs. More features or functionalities means additional testing and quality assurance (QA) are needed to ensure they work as intended and free of bugs. This can contribute to the overall cost of the project. Scope creep may also lead to increased project management overheads, as project managers need to spend more time re-planning the project, re-estimating costs, and communicating changes to stakeholders.
ECA Tech warrants that the Services will be performed using commercially reasonable skill and care. However, we cannot guarantee specific results or compatibility with all browsers and devices. Both parties agree to keep confidential all non-public information disclosed by the other party during the course of the project. Either party may terminate the agreement for cause with written notice. In the event of termination by the Client, payment will be due for Services rendered up to the date of termination.
